Findings and Order

On 7 October 2015, the Solicitors Disciplinary Tribunal found the following complaints against the Respondent proved on his own admissions:

The First Complaint

Breach of r. 10(2) and r. 10(3) of the SAR in that the Respondent failed to keep properly written up books and accounts of the Firm.

The Second Complaint

Breach of r. 3(1) of the SAR in that the Respondent failed to deposit the client’s money into the Firm’s client account without delay.

The Third Complaint

Breach of r. 9A of the SAR in that the Respondent failed to remedy promptly upon discovery his breach of r. 3(1) of the SAR.

The Fourth Complaint

Breach of r. 3(1) of the SAR in that the Respondent failed to deposit the client’s money into the Firm’s client account without delay.

The Fifth Complaint

Breach of r. 9A(1) of the SAR in that the Respondent failed to remedy promptly upon discovery of breaches of r. 3(1) of the SAR.

The Sixth Complaint

Breach of r. 2(e) of the SPR in that the Respondent compromised a proper standard of work by repeatedly failing to comply with the SAR.

Having considered submissions in mitigation made by Counsel for the Respondent and oral submissions from the parties with respect to costs at the hearing held on 3 December 2015, the Tribunal on 6 July 2016 ordered that :

  1. in relation to the First Complaint, the Respondent be fined HK$25,000.
  2. in relation to the Second Complaint, the Respondent be censured and fined HK$150,000.
  3. in relation to the Third Complaint, the Respondent be fined HK$40,000.
  4. in relation to the Fourth Complaint, the Respondent be censured and fined HK$200,000.
  5. in relation to the Fifth Complaint, the Respondent be fined HK$40,000.
  6. in relation to the Sixth Complaint, the Respondent be censured and fined HK$350,000.
  7. the Respondent pay costs of the Prosecutor, costs of the Law Society and costs of the Clerk to the Tribunal, as agreed.
